TEORY Terms of Use

Effective Date: October 6, 2026

These Terms of Use ("Terms") govern your access to and use of TEORY, operated by ICO GROUP ("ICO GROUP," "TEORY," "we," "us," or "our").

By creating an account or using TEORY, you agree to these Terms.

1. Eligibility

You must be legally permitted to use TEORY in your jurisdiction.

When creating an account, you agree to provide accurate information and maintain the accuracy of your account information.

2. Your Account

TEORY supports account creation and authentication through:

You are responsible for maintaining the security of your account and for activity conducted through your account.

You may edit your displayed name through the Account settings available in TEORY.

TEORY's color results and mixing recipes are estimates.

Actual physical paint results may differ because of lighting, cameras, displays, surfaces, pigments, paint characteristics, application methods, environmental conditions, and other factors.

You are responsible for verifying results before relying on them for a physical project, purchase, construction, painting, or other real-world application.

4. User Content

You retain ownership of photographs and other content that you submit to TEORY, subject to third-party rights.

By uploading content to TEORY, you grant ICO GROUP and its service providers a limited, non-exclusive right to host, store, reproduce, process, and display that content as reasonably necessary to provide and operate TEORY.

You represent that you have the necessary rights and permissions to upload the content.

5. Uploaded Photographs

IMPORTANT: TEORY currently stores uploaded project photographs as public files.

Although the associated project records are protected by account-level access controls, anyone who obtains the direct URL of a photograph may be able to access that photograph.

Do not upload confidential or sensitive photographs if you do not want them stored in this manner.

6. Projects and Saved Colors

Projects and saved color markers are associated with your TEORY account.

My Paints are currently stored locally on your device and are not synchronized with your account.

7. Free Usage

The current TEORY Free experience limits users to five recipe calculations.

TEORY may modify its free usage limits or features in the future.

8. Pro and Paid Features

TEORY does not currently process paid subscriptions or in-app purchases.

The current Pro/Paywall interface is not currently connected to a payment provider, Apple StoreKit purchase system, or subscription-processing system.

If paid features are introduced, additional pricing, subscription, and purchase terms may apply.

TEORY's software, interface, branding, design, technology, and original content are owned by or licensed to ICO GROUP and are protected by applicable intellectual-property laws.

You may not copy, reproduce, modify, distribute, reverse engineer, or commercially exploit TEORY except as permitted by law or by ICO GROUP.

Third-party paint brands, names, trademarks, and related intellectual property belong to their respective owners.

11. Availability

TEORY is provided on an "as available" basis.

We do not guarantee that TEORY will always be available, uninterrupted, error-free, or compatible with every device.

We may modify, suspend, or discontinue features or portions of the service.

12. Account Deletion

You may initiate deletion of your TEORY account from within the Account/Settings area.

Account deletion removes the account and associated records that TEORY can delete.

Because of the current limitations of the file-storage provider, uploaded image files may remain in storage after account deletion. Our Privacy Policy provides additional details.

13. Third-Party Services

TEORY depends on third-party services and infrastructure, including authentication, application infrastructure, database, file storage, and font services.

Your use of third-party authentication may also be subject to the applicable provider's terms and policies.

14. Disclaimer of Color Results

TEORY's color measurements, color analysis, and mixing calculations are provided for informational and practical assistance only.

They do not guarantee that a physical paint mixture will exactly reproduce a displayed color.

Before using a TEORY result for a significant physical project, you should verify the result using an appropriate physical sample or other real-world testing.

15. Disclaimer of Warranties

To the maximum extent permitted by law, TEORY is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied.

16. Limitation of Liability

To the maximum extent permitted by applicable law, ICO GROUP and its owners, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of TEORY.

Nothing in these Terms excludes liability that cannot legally be excluded.

17. Indemnification

To the extent permitted by applicable law, you agree to defend and indemnify ICO GROUP against claims, damages, liabilities, and expenses arising from your misuse of TEORY, violation of these Terms, or infringement of another person's rights.

18. Changes to the Service

We may change, update, add, or remove features from TEORY.

Future features, including paid features or subscription services, may be subject to additional terms presented before those features become available.

19. Changes to These Terms

We may update these Terms from time to time.

When material changes are made, we may update the effective date and provide additional notice where appropriate.

20. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

TEORY Privacy Policy

TEORY is a color analysis and color-mixing application operated by ICO GROUP ("ICO GROUP," "TEORY," "we," "us," or "our").

This Privacy Policy explains what information TEORY collects, how we use it, how it is stored, and the choices available to you.

When you create or use a TEORY account, we may collect and store:

TEORY supports account creation and authentication through Apple, Google, and email/password authentication.

When you use Apple or Google to sign in, information provided by the applicable authentication provider may be stored in your TEORY account.

TEORY allows users to create and store projects and color information.

Depending on how you use TEORY, this may include:

TEORY currently does not permanently store generated color recipes. Recipes are calculated locally in the application when requested.

3. My Paints

The My Paints collection is currently stored locally on your device.

It is not currently synchronized to your TEORY account or stored on our servers.

4. Photographs and File Storage

When you upload a photograph to a TEORY project, the photograph is stored using the file-storage infrastructure provided by our application platform.

Currently, TEORY project photographs are stored as public files.

The associated TEORY project record is protected by account-level access controls. However, the image file itself has a public URL. Anyone who obtains that direct URL may be able to access the image.

For this reason, you should not upload photographs containing information that you do not want accessible through a public file URL.

TEORY currently uses Google Fonts for certain typography. Your browser may send technical information such as an IP address when retrieving those fonts.

ICO GROUP does not sell your personal information.

TEORY does not currently use advertising networks or third-party behavioral advertising.

Information may be processed by service providers that provide the infrastructure necessary to operate TEORY.

Uploaded project photographs are currently stored as public files and may be accessible to anyone who obtains their direct URL.

10. Account Security

TEORY uses account-level access controls to restrict access to your project records.

Your projects are associated with your account, and users can access and modify only their own project records through the application.

No method of electronic storage or transmission can be guaranteed to be completely secure.

11. Data Retention

Account records, projects, saved markers, and account-related entitlement information are retained until deleted by the user or otherwise removed through the service.

When you delete your TEORY account, TEORY deletes:

Currently, uploaded photograph files stored in Base44 public storage are not deleted, because the current storage platform does not provide TEORY with a supported file-deletion mechanism. Those files may remain in storage after the associated project record has been deleted.

Account deletion is intended to permanently remove your TEORY account and associated account records that TEORY can delete.

Certain uploaded image files may remain in storage as described above.

California privacy laws may provide certain rights to California residents depending on whether the applicable legal requirements apply to ICO GROUP.

TEORY is not directed toward children under 13 and does not knowingly collect personal information from children under 13.

15. International Data Processing

TEORY may use service providers whose infrastructure operates in the United States or other jurisdictions.

We may update this Privacy Policy from time to time.
